These Terms and Conditions (“Terms”) govern your access to and use of the Epic Auto School mobile application and website (the “Service”). Epic Auto School is operated by Online Learning Solutions L.L.C-FZ (“we,” “our,” or “us”). By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

By using the Service, you represent and warrant that you are at least thirteen (13) years old and legally capable of entering into a binding agreement. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf. Personalized advertising data is not used for users under 18. Age is determined through platform age signals or by asking you directly. For users under 18, personalized advertising and cross-app tracking are disabled and our measurement tools run in a privacy-limited, aggregated mode, as described in our Privacy Policy.

1. Nature and Scope of the Service

Epic Auto School is an educational mobile application designed for written test preparation purposes. The Service is not a driving school, is not a government authority, is not affiliated with any department of motor vehicles or transportation authority, and does not issue licenses or certifications. All content provided through the Service is offered solely for educational and informational purposes.

The Service is designed exclusively for preparation for the standard non-commercial passenger vehicle written examination (commonly referred to as Class C in most U.S. jurisdictions). The Service does not prepare users for commercial driver’s license (CDL) examinations, motorcycle endorsements, commercial passenger vehicle classifications, hazardous materials endorsements, or any other specialized license category. Users seeking preparation for any license type other than a standard non-commercial passenger license should not rely on the Service.

We do not guarantee that you will pass any written, permit, or licensing examination, nor do we guarantee that examination questions will match content presented in the Service. Traffic laws, regulations, and examination formats may change without notice. You are responsible for verifying official and current information through appropriate government sources.

2. Jurisdiction Selection and Regional Content

The Service may offer content tailored to specific jurisdictions, including state-specific materials within the United States. You are solely responsible for selecting the jurisdiction that applies to you and for verifying that the selected content corresponds to the laws, regulations, and examination format of your location. We are not responsible for outcomes, including examination failure, resulting from incorrect jurisdiction selection or from reliance on content not intended for your location.

3. Educational Content and Independent Judgment

The explanations, recommendations, and solutions presented within the Service are based on widely accepted driving practices and general traffic safety experience. In certain circumstances, guidance may reflect commonly accepted best practices rather than direct quotations from a specific legal provision. The Service does not provide a complete or exhaustive guide to all possible traffic situations.

Real-world driving conditions vary depending on location, weather, road conditions, vehicle type, surrounding traffic, visibility, and other external factors. You must exercise independent judgment and comply with applicable traffic laws at all times. The Service is not a substitute for professional instruction, legal advice, or official government publications.

4. Simulated Content

The videos and scenarios presented within the Service are simulated three-dimensional representations created for educational purposes. Visual elements, including but not limited to distances, speeds, angles, timing, lighting, and road layouts, may be simplified, stylized, or adjusted for clarity. These representations are illustrative only and are not exact recreations of real-world conditions. The Service must not be relied upon as real-time driving instruction or as precise measurement guidance.

Certain videos and simulations may include vehicle models or designs that resemble real-world automobiles. Such representations are used solely for illustrative and educational purposes. We do not cooperate with, endorse, or have any affiliation with any automobile manufacturer, dealership, or brand. Any resemblance to specific vehicle models or manufacturers is purely coincidental.

5. Content Advisory

The Service contains educational content depicting traffic incidents, collisions, hazardous driving conditions, and other scenarios that some users may find distressing. Such content is included solely for educational purposes, to illustrate risks and promote safe driving.

Viewing this content is a normal part of using the Service. If you find particular content distressing, you may skip it or discontinue use. To the extent permitted by applicable law, we are not liable for emotional or psychological responses arising from ordinary use of the educational content. Nothing in this section limits any liability that cannot be limited under applicable law.

If you have a known history of trauma related to motor vehicle incidents and are concerned about how this content may affect you, you may wish to consult a qualified healthcare professional before using the Service.

6. Safety

The Service must not be used while operating a vehicle. You agree not to use the Service in any manner that distracts from or interferes with the safe operation of a vehicle, whether by you or by others. You assume full responsibility for using the Service in a safe environment and for complying with all applicable laws regarding device use.

7. Account Registration

Account registration is optional. You may use the Service without creating an account. After completing a subscription purchase, you will be offered the opportunity to create an account, which you may accept or skip. You may also create an account at any time from within the App.

If you choose to create an account, you agree to provide accurate information, maintain the confidentiality of your account credentials, and accept responsibility for all activities that occur under your account. Account sharing is strictly prohibited. You must notify us immediately of any unauthorized access to your account.

If you choose not to create an account, your learning progress and related data will be stored solely on the device on which you use the Service. See Section 7A (Local Data Storage and Loss of Data) for important information about your responsibilities in that case.

8. 7A. Local Data Storage and Loss of Data

If you use the Service without an account, all learning progress, quiz results, and related activity data are stored solely on your device. This information is not synchronized with or backed up on our servers, and we have no copy of it.

You acknowledge and agree that data stored only on your device may be permanently and irretrievably lost in a wide range of circumstances, including but not limited to: loss, theft, damage, malfunction, or replacement of your device; uninstallation or reinstallation of the App; operating system updates, factory resets, or device restorations; clearing of app data or storage; and any other event affecting your device’s local storage.

You are solely responsible for safeguarding your device and for any data stored on it, including making your own backups where possible. We are unable to recover, restore, transfer, or otherwise reproduce learning progress that was stored only on your device, and we accept no liability for any such loss. If you wish to back up your progress or access it across multiple devices, you must create an account; you may register at any time from within the App.

8. Subscriptions, Billing, and Refunds

Subscriptions and other purchases are offered exclusively through the Apple App Store and Google Play Store. The specific price, billing period, and renewal terms for each plan are shown to you at the point of purchase, and payment is charged to your Apple or Google account upon confirmation.

Plan types. The Service currently offers the following types of plans, the exact pricing and availability of which are displayed in the App at the time of purchase and may change:

  • Auto-renewing subscriptions (for example, weekly or monthly). These renew automatically at the end of each billing period, and your payment method is charged for the next period unless you cancel at least 24 hours before the current period ends. You can cancel at any time through your Apple or Google account settings; cancellation takes effect at the end of the current billing period.
  • Non-renewing access (for example, a one-month plan that does not renew). This is a single purchase that grants access for a fixed period. It does not renew automatically, and access ends when the period expires unless you make a new purchase.

We do not currently offer a free trial. If we introduce one in the future, its terms will be disclosed at the point of purchase.

The first learning topic is available to every user without a subscription, so that you can try the Service before deciding whether to purchase. Payment is charged at the time you subscribe.

Promotional or launch pricing may be offered at our discretion and for limited periods. Any comparison or discount shown (for example, “save vs weekly”) is provided for information only and reflects the difference between plan prices, not a reduction from a previously charged amount.

Refunds are handled exclusively by Apple or Google in accordance with their respective policies. We do not process refunds directly. Apple and Google are not responsible for the Service, its content, maintenance, or support.

9. Prohibited Conduct

You may not share accounts, resell subscriptions, copy, reproduce, distribute, record, or redistribute any content from the Service. You may not reverse engineer, decompile, or attempt to extract the source code of the Service, nor may you use automated tools or scraping mechanisms to access the Service. You may not attempt to bypass subscription systems or use the Service for commercial purposes. Violation of these Terms may result in immediate termination without refund.

10. Intellectual Property

All content made available through the Service, including but not limited to videos, animations, scripts, storylines, characters, character names, dialogue, voiceovers, teaching formats, narrative style, text, graphics, illustrations, quizzes, questions, software, user interface design, branding, logos, and trademarks, is owned by or licensed to us and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only. No rights are granted by implication, estoppel, or otherwise.

11. User Submissions and Feedback

If you submit feedback, suggestions, reviews, reports of errors, or any other communications regarding the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate such submissions for any purpose, including improving the Service, without obligation of compensation or attribution to you.

12. Changes to the Service

We reserve the right to modify, suspend, discontinue, or impose limits on any part of the Service at any time, with or without notice, and without liability to you. This includes modifying features, content, pricing, or availability in any jurisdiction.

13. Termination

We reserve the right to suspend or terminate your access to the Service, in whole or in part, at our discretion and without prior notice, including for violation of these Terms or for any conduct we deem harmful to the Service or other users. Upon termination, your license to use the Service ends immediately. We may retain your data as required by applicable law or as reasonably necessary for legitimate business purposes, as described in our Privacy Policy. You may terminate your use of the Service at any time by discontinuing use and, where applicable, cancelling your subscription through the Apple App Store or Google Play Store. You may also delete your account at any time from within the App.

14. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Driving involves inherent risks, and you acknowledge that real-world decisions depend on dynamic conditions requiring independent judgment. You assume full responsibility for any actions taken based on the educational content provided through the Service.

15. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for personal injury, property damage, driving accidents, legal violations, examination failure, loss of profits, loss of data, or any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the total amount you paid for the Service during the twelve (12) months preceding the claim, or (b) fifty United States dollars (USD $50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold us harmless from any third-party claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Service or your violation of these Terms. This section does not apply to claims arising from our own gross negligence or willful misconduct, or to the extent such indemnification is prohibited by applicable law.

17. Force Majeure

We shall not be liable for delays or failures to perform resulting from causes beyond our reasonable control, including but not limited to internet outages, cloud service disruptions, governmental actions, natural disasters, war, cyberattacks, or system failures.

18. Dispute Resolution and Arbitration

Please read this section carefully. It affects how disputes between you and us are resolved.

18.1 Informal resolution first. Before starting any formal proceeding, you agree to first contact us at [email protected] and give us at least thirty (30) days to resolve the matter informally. Most concerns can be resolved this way.

18.2 Arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding arbitration on an individual basis, administered in accordance with the rules of the Dubai International Arbitration Centre (DIAC) or another recognized arbitral institution agreed upon by the parties. The seat of arbitration shall be Dubai, United Arab Emirates, and the language of arbitration shall be English.

18.3 Exceptions. Notwithstanding the above, either party may:

  • Bring an individual claim in a small claims court in the party’s home jurisdiction, if the claim qualifies; and
  • Seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

18.4 Class action waiver. To the extent permitted by applicable law, disputes must be brought on an individual basis, and you waive the right to participate in any class, collective, or representative proceeding. If this class action waiver is found unenforceable in your jurisdiction, then this arbitration provision (Section 18.2) shall not apply to that dispute, and that dispute shall instead be resolved in the competent courts identified in Section 19. The rest of these Terms remain in effect.

18.5 Your rights. Nothing in this section prevents you from bringing an issue to the attention of a government agency or regulator, or limits any non-waivable right you have under the mandatory consumer protection laws of your place of residence.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically the regulations applicable to the free zone in which Online Learning Solutions L.L.C-FZ is registered, without regard to conflict of law principles. Where mandatory consumer protection laws of your country or state of residence grant you additional rights that cannot be waived by contract, those rights remain unaffected, and nothing in these Terms limits them.

20. Apple and Google Specific Terms

You acknowledge that these Terms are concluded between you and us, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, and the applicable store operator may refund the purchase price, if any. To the maximum extent permitted by law, Apple and Google have no other warranty obligation whatsoever with respect to the Service.

Apple and Google are not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries.

21. Copyright Complaints

If you believe that content within the Service infringes your copyright, you may submit a written notice to [email protected] including: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the material claimed to be infringing and its location within the Service; (c) your contact information, including name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner; and (f) your physical or electronic signature.

22. Export Controls

You agree to comply with all applicable export and trade control laws and regulations when using the Service, and you represent that you are not located in, or a national of, any country subject to comprehensive trade sanctions that would prohibit the provision of the Service.

23. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your personal information, including how advertising and measurement features run in a privacy-limited mode for users who indicate they are under 18. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

24. Severability and Survival

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Provisions relating to intellectual property, limitation of liability, disclaimer of warranties, arbitration, indemnification, and governing law shall survive termination of these Terms.

25. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings, whether written or oral.

26. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by other reasonable means, and the “Effective Date” above will be updated. Continued use of the Service after updates take effect indicates acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.

27. Contact

For questions regarding these Terms, you may contact us at [email protected].
